From my experience, the right to health is increasingly justiciable, though rarely absolute. I have seen courts enforce minimum standards, access to treatment, or non-discrimination rather than comprehensive policy guarantees. Its scope depends heavily on judicial culture and institutional capacity. I would recommend understanding it as a right to reasonable state action, not perfect healthcare outcomes.
